What Is an Intentional Release and Detain System?

In Minnesota today, whether you stay in jail before trial often comes down to one thing: whether you can pay cash bail. The Pretrial Justice Minnesota coalition wants to change that. We’re working toward a system where release and detention decisions are based on safety, individual circumstances, and due process, not on how much money someone has.
A key part of our vision is called Intentional Release and Detain, a new system that would replace Minnesota’s current cash bail system. The idea comes from research from Pretrial Justice Minnesota member the Minnesota Justice Research Center on redesigning Minnesota’s pretrial system with community input at the center. The video below breaks down what this system could look like in practice, and how it would change pretrial decisions across the state.
A Note on Domestic Violence and Supportive Programming
The video highlights how individualized supports can be part of a more intentional approach to pretrial release.
In cases involving domestic violence, those supports should reflect the specific dynamics of relationship abuse. Domestic violence is rooted in power and control over a victim-survivor, and effective responses may include domestic abuse transformation programming alongside other supports, such as chemical dependency treatment if relevant.
This wider range of interventions can help ensure that responses are tailored to the circumstances of each case while supporting safety and accountability.
